Wynn Signature Chinese Wine Awards – Terms & Conditions
1. Purpose, Definitions and Interpretation
1.1. The aim of the Wynn Signature Chinese Wine Awards is to promote Chinese Wine and to contribute to the development of the industry. Each year, the Award Judges shall contribute to this achievement by selecting the best wines produced in the People’s Republic of China. Wynn shall continuously collect entries and announce the awards at the end of the Competition. The Judges shall participate impartially in this selection and seek to reward the best wines. In order to ensure impartiality, the Judges are instructed to recuse themselves from voting in any category where they may have a conflict of interest. To ensure all entries have a fair chance of winning an award, Wynn reserves the right to balance the number of awards each Entrant shall have in the same year.
1.2 In these Terms and Conditions (also referred to as "Rules") unless the context otherwise permits, the following words shall have the following meaning:
"Award" means a Gold, Silver or Bronze medal or Wynn Signature Trophy awarded under the Competition;
“Classes” means Wynn Signature Gold, Silver and Bronze awards;
“Competition” means the annual Wynn Signature Chinese Wine Awards held by Wynn Resorts (Macau) S.A.;
“Competition Platform” means the platform accessible via the Wynn Signature WeChat Mini-Program or Wynn Signature Website;
“Entrant” means a producer, importer, distributor or retailer who has submitted an Entry;
“Entry” means the wine(s) entered into the Competition by an Entrant;
“Entry Form” means the entry form for the Competition, to be completed via the Competition Platform;
"Entrant IP" means IP Rights belonging to, associated with or otherwise submitted to Wynn or used by Entrant in or in relation to the Competition.
"IP Rights" means any trademarks, service marks, logos, trade names, corporate names, Internet domain names, patents, registered designs, copyrights, design rights, database rights, rights in designs, inventions, semiconductor topography rights, know-how, trade secrets or similar right exercisable anywhere in the world, and all applications or rights to apply for the same (where such applications can be made), whether presently existing or created in the future, and whether registered or not, and all benefits, privileges, or rights to sue, recover damages and obtain relief for any past, current or future infringement, misappropriation or violation of any of the foregoing rights;
“Logistic Partner” means Macan Logistics Limited
“Rules” means these rules for entering the Competition;
“Shipping Agent” means Wynn’s appointed consolidated shipping agent, Macan Logistics Limited, which has its registered office located at Terreno junto a Avenida do Aeroporto, Zona de Aterro entre Taipa e Coloane, (centro Logistico) Macau and is a company registered in Macau under company registration number 58501 SO; and
“Website” means www.wynnsignature.com;
“Wynn” means Wynn Resorts (Macau) S.A., which has its registered office at Avenida da Nave Desportiva, Palácio Wynn, COTAI, Macau;
"Wynn Group" means the high-end resort, hotel and casino development and operation group owned by WYNN RESORTS, LIMITED, of which Wynn is a group member.
"Wynn Signature IP" means IP Rights used in or in relation to the Competition, including but not limited to the trademarks "永利臻典", "WYNN SIGNATURE", "" and other marks containing the above marks (in plain or stylized text), Award designs, bottle sticker designs, and certificate designs, all belonging to, associated with or otherwise used by the Wynn Group.
“Wynn Warehouse” means the Competition warehouse Room 1503, No.3242, Huandao East Road, Hengqin New Area, Zhuhai (SANY South Headquarters Building).
1.3 In these Rules where appropriate: words denoting the masculine gender include the feminine and neutral genders and vice versa; words denoting a singular number include the plural and vice versa; references to the definite article shall include the indefinite article and vice versa; references to persons shall include firms, companies and other organisations and vice versa; reference to a statutory provision includes a reference to the same as modified, re-enacted or both from time to time and any subordinate legislation made under the same; headings shall not affect interpretation; and words such as “include” or “including” are to be construed without limiting the generality of the preceding words.
2. Entering the Competition
2.1. Entrant can enter the Competition by submitting an Entry Form on the Competition Platform, and delivering its Entry to Wynn in accordance with Clause 5 (Delivery, Risk and Title). Entries that do not arrive by the entry deadline cannot participate in the Competition.
2.2. The Entry Form must be completed via the Competition Platform by creating an account or logging in to an existing account on the Competition Platform. Wynn accepts no responsibility for Entry Forms that are not successfully submitted.
2.3. Entrant is responsible for submitting its Entries online via the Competition Platform. Entries submitted outside Wynn’s online platform will only be accepted at Wynn’s discretion.
2.4. Where the same Entry is submitted by more than one Entrant, each Entrants’ stockists’ details will be featured equally in the report of the tasting.
2.5. By submitting an Entry to the Competition, Entrant agrees to be bound by these Rules.
3. Criteria for Entries
3.1. Entries must:
3.1.1. be made exclusively from grapes grown in the People’s Republic of China;
3.1.2. result from the partial or complete alcoholic fermentation of fresh grapes, whether crushed or not, or must;
3.1.3. with the exception of sweet wines, have an actual alcohol content of not less than 5% by volume;
3.1.4. have a minimum production quantity of 900 litres (100 cases of 12 bottles of 750ml) available to the market on release, with the exception of sweet and fortified wines, which must have a minimum production quantity of 450 litres (50 cases) whereas a portion of the entire production of the winning Entries and the Gold medal-winning Entries shall be available and rendered for commercial distribution after the results of the Competition are published;
3.1.5. be finished and stored in their final container; and not be tank or barrel samples;
3.1.6. be sealed with the same closure as the final, commercially available wine;
3.1.7. be contained in a 750ml bottle, with the exception of sweet and fortified wines, which may be contained in 250ml, 375ml, or 500ml bottles.

3.1.7. be contained in one of the following alternative formats:
3.1.7.1. Bag in Box (up to 3L)
3.1.7.2. Wine Pouch (up to 3L)
3.1.7.3. Aluminium Can
3.1.7.4. Carton (e.g. Tetra Pak)
3.1.7.5. Paper Bottle (up to 1L)
3.1.7.6. PET Bottle (up to 1L);
3.1.8. be labelled in accordance with Chinese legislation in force from time to time, including but not limited to (i) geographical area of origin; (ii) product category; (iii) producer details; (iv) nominal volume; (v) actual alcoholic strength; and (vi) Lot number;
3.2. The front and back labels for the Entry must be adhered on the bottles entered for tasting in accordance with Chinese legislation in force from time to time, and must state the following, including but not limited to: (i) name of producer; (ii) name of wine; (iii) vintage (where applicable); (iv) country of origin; (v) region of origin (where applicable); (vi) sub-region (where applicable); (vii) bottle size; (viii) alcoholic strength; and (ix) Lot number (where applicable);
3.3. Entries must be produced entirely and bottled in the People’s Republic of China and available for commercial purposes;
3.4. There is no limit to the number of entries that may be submitted by an Entrant;
3.5. In the event that Entrant is not the producer of an Entry, Entrant warrants that it has all necessary consents and permissions to enter the Entry into the Competition. Entrant will indemnify Wynn for any claims arising from Entrant submitting an Entry that Entrant is not entitled to submit;
4. Pricing
4.1. Pricing is not taken into consideration when judging the Entries. Entrants must provide the correct free on board (“FOB”)/ex-cellar price or select the correct retail price band per bottle for each Entry.
4.2. The FOB/ex-cellar price is the price charged by the producer to the wholesaler. The FOB/ex-cellar price does not include any of the following costs: (i) freight costs, (ii) operating costs; (iii) profit margins (distributor and retailer); or (iv) Duty and VAT.
4.3. Wynn will convert the FOB/ex-cellar price using the standard industry conversion formula to a retailer’s suggested price in RMB, HKD, USD.
4.4. All FOB/ex-cellar prices are kept confidential, are for Wynn’s internal use only to ensure Entries are judged in the right category, and will not be published or passed onto a third party.
4.5. Entries retailing at under RMB288 (incl. taxes) are eligible for the [Best Wine Under RMB288 Trophy].
4.6. The FOB/eEx-cellar price and the retail price band must be per bottle and not per case of 6 or 12.
4.7. The FOB/ex-cellar price or the retail price band per bottle quoted at the time of entry must accurately represent the Entry’s predicted retail price and not a discounted or promotional price, and must be valid for 12 months after publication of the Competition results.
4.8. Any major discrepancies between the FOB/ex-cellar price or the retail price per bottle quoted at the time of entry and the eventual retail price, except for factors outside of Entrant’s control (including tax and duty), may result in the Entry’s award being withdrawn, and future participation in the Competition may be prohibited.
5. Delivery, Risk and Title
5.1. Four (4) samples of each Entry of 750ml per bottle, or six (6) samples of each entry of 500ml, or eight (8) samples of each entry of 375ml, or twelve (12) samples of each entry of 250ml must be submitted to Wynn in accordance with these Rules. An exception to this is Bag in Box & Wine Pouches of 3 litre where only two (2) samples are required per entry.
5.2. It is Entrant’s responsibility to ensure that its Entries are delivered to Wynn in accordance with the deadlines detailed on the Mini-program or website.
5.3. Entrant may deliver its Entries:
5.3.1. directly to Wynn’s Warehouse; or
5.3.2. to the Shipping Agent’s depot for consolidated shipment; or
5.3.3. hand-delivered to the Wynn Signature stand at specified trade shows.
5.4. Please go to ‘Shipping’ for further terms, fees and restrictions applicable to each delivery option. Shipping must be paid for as part of the entry process, and shipping costs are not refundable in any circumstances.
5.5. Entrants who wish to use the Shipping Agent must select the consolidated shipping option when submitting their Entry, as an additional payment is required when using this service. For any Entries that are sent via the Shipping Agent and are not paid for at time of entry, payment will be sought by Wynn. Failure to pay for this service will result in Entries being removed from the Competition.
5.6. Entries that arrive after the deadline dates or that are delivered to the Wynn hotel and procurement office in Macau will not be accepted.
5.7. Wynn recommends the use of its Shipping Agent, as this will be a more cost-effective method and will help ensure the safe arrival of the Entry. If Entrant is unable to use the Shipping Agent, Wynn recommends that Entrant uses a shipper that allows Entrant to track its delivery to confirm that its Entry has arrived.
5.8. It is Entrant’s responsibility to contact the Shipping Agent or its courier company to confirm the delivery deadline, address and documentation required.
5.9. Entrant will be responsible for payment of all delivery charges, duties, taxes, insurances and storage. All such charges must be paid by Entrant in advance of receipt of the Entry by Wynn. If Entrant uses the Shipping Agent, it is Entrant’s responsibility to pay all delivery charges up to the Shipping Agent’s depot.
5.10. Entrant must inform its courier that Entrant, as the consignor or sender, will pay all surcharges, duties and tax, otherwise the Entries will not be accepted and will be returned at the Entrant’s cost.
5.11. It is Entrant’s responsibility to ensure that Entries arrive in good condition.
5.12. Entrant must complete and affix the delivery label, which can be downloaded by Entrant in its online account after submission of the Entry Form, on the outside of the box and on every bottle. Entrant must indicate the name of its company and Entry on the outside of the box to assist Wynn and the Logistic Partner in correctly identifying the Entry when it arrives.
5.13. Entrant will receive an automated digital confirmation when all samples of all its Entries have been received at the Wynn Warehouse and checked by Wynn. Entrants can also check the arrival of the delivery by logging in to its online account.
5.14. Wynn will notify Entrant in case of discrepancies between a received Entry and the Entry in Entrant’s online account. If Wynn does not hear from Entrant within the deadline, Wynn will use the information on the Entry label on the bottles received by Wynn and update the Entry in the Wynn system accordingly. Once the Entries are judged, no changes can be made to the Entry details.
5.15. Hand-delivery in accordance with Clause 6.3.3 is only available to exhibitors at the trade show where such Entry is submitted, and only Entries that are registered will be accepted by Wynn.
5.16. The Entries will be transported at Entrant’s risk and it will be Entrant’s responsibility to arrange adequate insurance. Wynn and the Logistic Partner will not be liable for any loss or damage to the Entries whatsoever whilst the Entries are in the possession of Entrant, the Shipping Agent, or at any stage during the delivery process.
5.17. Title (i.e. ownership) of the Entry will be transferred to Wynn upon receipt of the Entry at the Wynn Warehouse.
5.18. Refunds will not be issued after the Competition deadline for any cancellations, late deliveries, or non-deliveries.
5.19. Upon completion of the Competition, any unopened Entries will be destroyed, used at Wynn events, or sold in aid of Wynn’s appointed charities. Leftover Entries will not be returned or available for collection.
6. The Competition
6.1 Entries are organised for tasting by region, colour, grape, style, vintage, levels of residual sugar and price points to ensure that wines are judged among wines of the same class.
6.2 The Entries will be judged by blind tasting by a panel of judges.
6.3 All Gold medal-winning Entries will be re-tasted by Panel leaders, Vice Chairs, and the Chairman.
6.4 All >95 point Gold medal-winning Entries will compete for the 'Wynn Signature Trophies'.
6.5 The judges' decisions will be final and will not be open to challenge.
6.6 Entrants will not have any involvement in the appointment of the judges.
6.7 Judging Process.
All Judges are chosen based on their industry knowledge and expertise, and come from a broad range of industry sectors, including but not limited to a combination of wine educators, winemakers, viticulturists, wine marketers, retailers, sommeliers, journalists and expert amateurs of wine. Judging panels shall consist of one panel chair, two senior Judges and two associate Judges. The Vice-Chairs and Chair of Judges shall oversee each panel and have the final power to arbitrate the awarding of points.
All entries are judged 'blind' and assessed on their own merits against a set of criteria. Judges shall not have access to an Entry other than from the glass containing it, which is presented to them by stewards. Judges shall not at any time prior to the announcement of Awards have any access to or any knowledge of the identity of the Entry.
Where a Class is for a variety of different blends, vintages or varieties, as much as reasonably possible, like will be grouped with like by the Chair of Judges. Judges will be provided with the vintage and varietal make up of each Entry as listed on the application for Entry by the Entrant.
Large Classes may be 'split' across a number of panels. Split Class judging is processed after each panel involved determines their 'top gold' from within their portion of the Class. The Panel Chairs will then re-convene with the Chair of Judges, re-taste in random order and determine the single top gold for that Class.
Within each Sparkling or Fortified Class, Entries will be grouped for judging according to Class-specific criteria, as determined by the Chair of Judges. Judges will be provided with Entry descriptions as specified on the Application for Entry.
7. Winners
7.1 Entrants will be informed of when the results of the Competition are available by Wynn. Entrants will only be able to retrieve the results for their Entry until the full results are made public.
7.2 The winning Entries in all Classes will be published upon completion of each Competition and winning Entrants acknowledge and agree that Wynn may publish details and particulars of the winning Entries.
7.3 All the winning wines will be published on the Wynn Signature Competition Platform and its digital channels. The Trophy winners will all be featured at the Awards Gala Dinner, Masterclass sessions, and international roadshow events hosted by Wynn. All winning Entries will be published according to Wynn's format which is 'Producer, Wine Name, Sub Region, Region, Country, Vintage, Style'. 'Producer Name' and 'Wine Name' may therefore be changed from the originally submitted by Entrant in order to ensure that Wynn's records reflect the information displayed on the Entry's front label, allowing for easy identification by consumers.
7.4 Winning Entrants agree that they will take part in any publicity that is reasonably required by Wynn.
7.5 Entrants agree that Wynn may photograph and reproduce photographs of Entrants and/or winning Entries and shall use, process and store such data according to Clause 15.
7.6 Winning Entrants will be issued certificates via registered post or provided access for a digital download.
8. Intellectual Property
8.1 Entrants acknowledge and agree that Wynn Group owns or otherwise has the right to use Wynn Signature IP and any unauthorised use, reproduction or alteration of Wynn Signature IP is strictly prohibited.
8.2 Entrants have no rights, title or interest in relation to the Competition or Wynn Signature IP.
8.3 Save and except for the use of Wynn Signature IP by winning Entrants as provided in Clauses 8.4 and 8.5, Entrants shall not use any Wynn Signature IP without prior written consent from Wynn Group. Nothing in these Rules shall be construed as granting Entrants any rights to such Wynn Signature IP. Entrants shall not use IP Rights of any third party without that third party's prior authorisation. Entrants shall not use any IP Rights in a way that is likely or intended to cause confusion about the owner or authorised user of such IP Rights.
8.4 Winning Entrants are granted a worldwide, perpetual, revocable, non-exclusive, royalty-free, sub-licensable licence to use Wynn Signature IP in any online or physical materials for the purpose of promoting their winning Entries, provided that:
(i) Winning Entrants are only permitted to use any Wynn Signature IP that is accessible on the Website.
(ii) Prior to any use of Wynn Signature IP, winning Entrants must submit a written proposal to Wynn containing details of their intended use for review and obtain Wynn's prior written consent to such use.
(iii) Winning Entrants shall at all times comply with the written proposal approved by Wynn under Clause 9.4(ii), any Brand Guidelines accessible upon request from Ms. Danielle Liu (danielle.d.liu@wynnpalace.com), and any other instructions, specifications, standards, or directions given by the Wynn Group from time to time in relation to the use of Wynn Signature IP.
(iv) Entrants shall use Wynn Signature IP on or in relation to their winning Entries only and not any other products. For the avoidance of doubt, "winning Entries" refer to Entries that have won an Award in the Competition.
8.5 With respect to the use of Wynn Signature IP on bottles of the winning Entries, winning Entrants additionally agree that:
(i) Wynn Signature IP may only be affixed to bottles that adhere to the same criteria (for example, vintage, residual sugar, style, oaking, bottle size, etc.) as the winning Entry.
(ii) Winning Entrants will be given bottle stickers bearing Wynn Signature IP ("Wynn Signature Stickers") that can be affixed to bottles of their winning Entries. The initial amount of stickers given to the winning Entrants shall be determined by Wynn. Additional Wynn Signature Stickers may be ordered from Wynn, which has sole and absolute discretion on whether to fulfil such order. For the avoidance of doubt, Wynn Signature Stickers may only be purchased and used by winning Entrants.
(iii) Winning Entrants shall ensure that each bottle bearing Wynn Signature IP sold or otherwise supplied by them complies with all applicable laws, regulations, industry standards and codes of practice in all relevant sales markets.
8.6 If a winning Entry has other labels and/or names (e.g. for use in different sales markets) than those submitted to the Competition, winning Entrant may use, or permit its authorised sellers to use, Wynn Signature IP on or in relation to those other labels and/or names, provided that such use complies with these Rules and winning Entrant has obtained Wynn's prior written permission for such use prior to the judging week. Permission will not be given to the use of Wynn Signature IP on or in relation to such other labels and/or names of a winning Entry after the judging week has commenced.
8.7 When promoting a winning Entry or publicising an Award, winning Entrants must always state the year in which the Award was won. No changes can be made to the name and details of the winning Entry after close of the Competition.
8.8 Winning Entrants shall promptly inform Wynn of any suspected unauthorised use of Wynn Signature IP (or any confusingly similar IP Rights) of which they become aware, and shall provide Wynn with such documents, information, and assistance as they can in relation to any such use.
8.9 Wynn gives no warranty and makes no representation in or pursuant to these Rules that the use of Wynn Signature IP, nor the manufacture, use, sale or other dealing in any product bearing Wynn Signature IP, does not or will not infringe the rights of others.
8.10 Wynn Group has sole and absolute discretion to revoke the licence in Clause 8.4 at any time upon 14 days' written notice to an Entrant.
(i) Upon the expiry of the 14-day period ("Expiry"), the notified Entrant shall immediately cease, and shall ensure that its authorised sellers cease, all use of the Wynn Signature IP save as set out in this clause.
(ii) Where Wynn Signature IP has been authorised to be used on bottles of winning Entries:
(a) Entrant shall, for a period of 90 days after the date of the Expiry, have the right to sell or otherwise dispose of all bottles bearing Wynn Signature IP in Entrant's possession, provided that the use of Wynn Signature IP complies with these Rules.
(b) Within 120 days after the date of the Expiry, Entrant shall promptly destroy or, if Wynn shall so elect, deliver to Wynn or any other person designated by Wynn, at Entrant's expense, all remaining bottles bearing Wynn Signature IP that Entrant has not disposed of within 90 days after the date of the Expiry.
8.11 Where Entrants are authorised to use Wynn Signature IP pursuant to these Rules, Entrants shall ensure that their use in no way reduces or diminishes the reputation, image, and prestige of Wynn Signature IP or of products sold under or by reference to Wynn Signature IP.
8.12 Any Entrant licenced to use Wynn Signature IP shall sign such documents and give such assistance as Wynn Group may reasonably request from time to time for Entrant to be recorded as licensee against any relevant trademark registration or pending application which includes Wynn Signature IP, and to have any such recordal removed on termination of the licence.
8.13 Unauthorised use, reproduction or alteration of Wynn Signature IP may result in Wynn withdrawing the offending Entrant's Award and prohibiting the offending Entrant from future participation in the Competition.
8.14 In consideration of the opportunity to participate in the Competition, Entrants grant Wynn a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sub-licensable licence to use Entrant IP in any form, media or technology whatsoever, for the purposes of administering, organising, providing, hosting, fulfilling, promoting, marketing, advertising and/or showcasing the Competition, and as otherwise permitted under these Rules.
8.15 Wynn and Entrants warrant and undertake that they have all the rights, power and authority necessary to grant the licences described in these Rules with respect to Wynn Signature IP and Entrant IP respectively.
8.16 Entrants agree that they waive, and have obtained all waivers from their employees and representatives, any and all moral rights in Entrant IP.
8.17 Wynn reserves the right (but shall have no obligation) to remove, pre-screen, review, flag, filter, modify or refuse any Entrant IP, at its sole discretion.
9. General
9.1 If any part of these Rules is held by a court of competent jurisdiction to be unenforceable, the validity of the remainder of these Rules will not be affected.
9.2 A person who is not a party to these Rules has no right to enforce any term of these Rules, but this does not affect any right or remedy exercised by a third party as permitted by law.
9.3 Nothing in these Rules shall be construed as creating a partnership, joint venture or agency relationship between Entrant and Wynn.
9.4 No waiver by Wynn of a breach of any provision of these Rules shall be considered to be a waiver of any prior or subsequent breach of the same or any other provisions, and no waiver shall be implied by Wynn taking or failing to take any other action.
9.5 In the event that, for reasons beyond the reasonable control of Wynn, it is necessary or advisable for the Competition to be cancelled, Wynn shall not accept any liability whatsoever for any direct or indirect loss of profit, damage or expense of any kind incurred as the result of such a cancellation.
9.6 Wynn may vary these Rules at any time without notice to Entrants. Any revision of these Rules will be placed on the Website without notice to Entrants. In the event that Entrant does not agree to be bound by any amended Rules, they must withdraw from the Competition.
9.7 Any personal information, including Entrant's name, age, address (including postcode), email address and any other information submitted by Entrant on the Entry Form, will be used by Wynn in accordance with its privacy policy at https://www.wynnresortsmacau.com/en/privacy-policy.
9.8 If there is any reason to believe that there has been a breach of these Rules, Wynn may, at its sole discretion, reserve the right to exclude Entrant from participating in the Competition and revoke any permission or authorisation previously granted to the Entrant for the use of Wynn Signature IP.
9.9 Any notice given under these Rules shall be in writing and in Chinese, Portuguese or English and signed by or on behalf of the party giving it, and shall be served electronically, by hand or by prepaid first class recorded delivery (including special delivery) or first class registered post or, in the case of an address for service around China, prepaid national registered courier, in each case to the address and for the attention of the relevant party set out in the Entry Form or these Rules (or as otherwise notified by that party under this clause). Any notice shall be deemed to have been received if hand-delivered or sent by prepaid first class recorded or registered post or prepaid international recorded airmail, at the time of delivery.
9.10 Wynn reserves the right to cancel the Competition at any stage, and for any reason, including circumstances that are outside of Wynn's control.
9.11 These Rules shall be governed by the laws of Macau and any dispute shall be subject to the exclusive jurisdiction of the Macau courts.
10. Excess judging stock
Please note that all Entries become property of Wynn Signature once delivered. Excess stock may be used for promotional purposes including (but not limited to) VIP and media tastings, presentation dinner, exhibitor and trade tastings, consumer event, wine education and displays.
11. Misrepresentation
(a) Entrants must not misrepresent or make improper use of an Entry. Should Wynn deem Entrant to be misrepresenting an Entry, Entrant may be subject to disqualification from further Awards conducted by Wynn;
(b) Any Entrant falsifying its attainment of the product may be disqualified from further Shows conducted by Wynn;
(c) Wynn reserves the right to take infringement action against Entrant for its use of Wynn Signature IP, the misrepresentation and/or misuse of the product under the relevant laws and regulations;
(d) Wynn reserves the right to report the misuse or misrepresentation to the relevant authorities.
12. Protests & disqualifications
Entrant shall accept the Judges' decision on the merits of its respective Entry. A protest may be provided to Wynn in writing within seven (7) calendar days of the announcement of the Awards by the Entrant with an Entry in the Class to which a protest relates. Notification of protest must be made in writing to:

Should Wynn deem that an Entry does not meet the requirements of the Competition, the Entry may be disqualified. An Entrant who is deemed by Wynn to have breached any of these Rules may be disqualified by Wynn from entering any of its future competitions.
An Application for Entry received from an Entrant who has been disqualified from the Competition by Wynn shall not be accepted during the period of such disqualification. Should any such application be accepted, it shall, when discovered, be deemed void and the Entry and any Award made to such Entrant shall be forfeited to Wynn. Where an Entry or an Entrant is disqualified and their prize is forfeited, Wynn may (but is not obliged to) promote the Entry next in order to that prize.
13. Auditing
(a) Wynn will appoint any person (a 'Wine Auditor') to undertake random pre-judging and post-judging audits relating to any Entry entered into the Wynn Signature Awards.
(b) Entrant must cooperate with and do all things reasonably required by a Wine Auditor in connection with any Audit and adhere to arrangements that have been made between Wynn and Entrant.
(c) Entrant must extract and keep on file a copy of bottled stock levels at the time of entry (and for current vintage white/rosé wines, at the time of delivery), winemaking integrity reports, and such other records as are required to demonstrate the truth and accuracy of all information stated in Entrant's Entry Form. This may include details of provenance, grape or wine lab analysis reports and commercial availability as applicable.
(d) Entrant hereby consents to an Wine Auditor, in the conduct of a Wine Audit, to enter, with reasonable notice, Entrant's premises as nominated and inspect all wine, books, electronic and hard copy records thereon, or to request relevant documentation electronically for the purpose of verifying the authenticity of any information stated in Entrant's Entry Form.
(e) An Entrant undergoing a Wine Audit must permit the Wine Auditor to take from the Entrant's premises up to three (3) samples (free of charge) taken at random from the stock on hand of any Entry for comparison with the original Entry.
(f) Wynn may also obtain retail samples sourced from the marketplace to compare with the original Entry. A random sample of all Entries will be targeted for this type of audit 2025.
(g) Wynn reserves the right to audit Entries within twelve (12) months following the Wynn Signature Awards.
If Entrant fails to comply with these provisions, or as a result of the Wine Audit, any discrepancy is disclosed, or a sample taken is not identical with the original Entry, Wynn may:
(a) cancel any Award won by Entrant;
(b) disqualify Entrant from further competition for such period as Wynn considers appropriate;
(c) publish to such persons, as Wynn considers appropriate, the fact of any such cancellation and/or disqualification in respect to the Entry and Entrant.
Wynn may publish in any medium the results of any such inspection or analysis. Neither Entrant nor any other person shall have any claim against Wynn or against any Councillor, member, employee, agent or representative in respect of any matter published.
14. Power to cancel or alter
Wynn may, without assigning a reason:
(a) Alter the Closing Date of Entry for the Competition;
(b) Remove any Entry from Wynn's premises or warehouse, or cause any Entry to be removed from Wynn's premises;
(c) Alter the conditions of the Competition, including but not exclusive to the judging conditions and process followed;
(d) Rule that an Entry or Entrant may not compete or is ineligible to compete;
(e) Alter the date, time or place on or at which the judging or Awards Presentation is scheduled to take place; or
(f) Alter a Judge scheduled to Judge the Event.
Notification of change will be listed on the Wynn Signature website and on the Competition Platform.
Whilst every effort will be made to release results on the date indicated, Wynn reserves the right to:
(a) Defer announcing results until the Chair of Judges' report is finalised; or
(b) Cancel the Event.
The rights set out above apply notwithstanding:
(a) Wynn's acceptance of an Entry;
(b) Inclusion of an Entry in the Results Catalogue; or
(c) The issue of any other document.
15. Personal Data
By participating in this Competition, Entrant agrees to items (a) through (e) listed below:
(a) Entrant acknowledges that the Competition is entered through the Competition Platform. Data input or made available in connection with the Competition (as a result of Entrant's actions, omissions or otherwise) may be stored on the Competition Platform from which this Competition is made accessible and may also be stored at Wynn's servers in Macau.
(b) Entrant authorizes Wynn and Wynn's Contractors (as defined below) to collect, process, combine and store, by any means and as applicable, Entrant's personal data (including, without limitation, Entrant's personal information on the Competition Platform from which this Competition is made accessible, Entrant's name, address, telephone number, information on the award won (if any) and its redemption, information on Entrant's identification document (if necessary), information concerning the participant's interactions with Wynn (if necessary) and the respective time, and any other data related with Entrant's participation in this Competition) (all collectively "Data"), for the following purposes: (i) processing associated with the participation in this Competition, including award redemption (if any), (ii) announcing and contacting Competition winners, (iii) enforcing the terms and conditions of this Competition, (iv) conducting audits by Wynn auditors and professional assessments (risk-based or otherwise) by Wynn's advisors, (v) ensuring the safety of persons and assets, and (vi) complying with directives from public authorities with jurisdiction over Wynn. Notwithstanding the foregoing, if any Data be considered as "sensitive personal information", Wynn shall only process such sensitive personal information for a specific purpose, with sufficient necessity, while taking strict protection measures as required by applicable laws. Wynn will comply with the laws and regulations that are applicable to the conducts contemplated by these Terms.
(c) Entrant authorizes that, subject to Wynn's privacy policy (available as indicated below), the Data be: (i) disclosed to designated service providers or "Contractors" (including, without limitation, and as applicable, Wynn external auditors, legal and financial advisors, etc., service providers offering Wynn development services and data review services for this Competition, service providers that own or operate the Competition Platform from which this Competition is made accessible, and other service providers that own, operate or assist Wynn with systems or the Competition Platforms the services provided by Wynn are based in, data management service providers and courier and mail service providers, If applicable), and to public authorities with jurisdiction over Wynn, and (ii) transferred to, processed or stored in any jurisdictions, or on the cloud, including, without limitation, the United States of America and Macau. Entrant hereby gives a separate consent to the third-party service providers processing Entrant's personal data according to the provisions of these Terms and Conditions.
(d) e Entrant accepts that the Data shall be kept in Wynn's archives or systems, for a period of one (1) month from the end of the Competition Period, unless Wynn may need to retain the information for a longer period, for purposes provided for in the law, or is required by law or public authorities to retain the information for a longer period. Entrant has the right to request access to Data being kept, the right to request any rectification/update/deletion to the Data (to the extent possible and commercially reasonable), and the right to withdraw the consent given by writing to Wynn at dataprotection@wynnmacau.com. Entrant acknowledges that requests for Data access/correction/deletion may be subject to payment of reasonable administration costs. Entrant further acknowledges that the withdrawal of the consent may prevent Entrant from accomplishing the purpose or redeeming the benefit for which the information is required (preventing in some cases participation in the Competition if the relevant Data is necessary for participation).
(e) Entrant also accepts the remaining terms of the Wynn's personal data/privacy policy available at https://www.wynnresortsmacau.com/en/privacy-policy. If Entrant chooses to withdraw its consent, Wynn will still be required to comply with any public authorities' directives requiring collection, processing and storing of Data as set out herein.
